Which license your service work needs

Any retailer selling, renting or leasing products or services in South Dakota needs a sales tax license. If your work is construction services, meaning construction, building, installation, repair or remodeling to real property, you need a contractor's excise tax license instead. Some trades need both, because the two taxes split by job, not by business.

One license per location, or one statewide

A business with multiple South Dakota locations must hold a license for each location. The Department also allows a consolidated statewide filing for eligible businesses, so one return covers everything instead of one per site.

The statewide permit has conditions: identical ownership, the same federal identification number, the same Standard Industrial Classification number and the same license type across the locations. The application must be approved by the Department before consolidated filing starts.

For a one-truck or one-shop service business this section rarely bites. It starts to matter the day you open a second shop or a second crew town.

What operating without the license costs

Operating a taxable business without a tax license is a Class 1 misdemeanor. The penalty if convicted is up to $1,000 and/or one year in jail, and continuing after the Department notifies you that a license is required can be charged as a felony carrying up to $4,000 and/or two years.

Your first filing period after the card arrives

A business must file a tax return every reporting period, even in a month with no sales. Mark the due date now: paper returns are filed and paid by the 20th of the month after the period, electronic returns are due the 20th and electronic payments the 25th.

Can I start working before the license is approved?

The Department requires licensing before starting taxable work in South Dakota, and operating a taxable business without a license is a Class 1 misdemeanor. Apply first, then invoice. If you have already started, apply now rather than waiting for the Department to find you.

Does the license expire?

The Department's license materials do not describe a renewal fee or expiry for the sales tax license itself. What expires is your standing if you stop filing: returns are due every period even with no sales, and late filing draws the 10% penalty.

Is the sales tax license the same as my trade license?

No. The sales tax license comes from the Department of Revenue and covers collecting and remitting tax. Trade boards issue separate occupational licenses, for example the cosmetology board for salons or the contractors' licensing path for electrical work.
